Ember Danger: Wind-driven embers can travel miles ahead of the actual wildfire, igniting homes in areas far removed from the fire itself. In fact, it is estimated that 90% of homes destroyed by wildfires are ignited by embers rather than direct contact.

The EmberGuard DIY Rooftop Wildfire Deterrent System ("the Product") is designed as a supplemental fire-mitigation tool intended to provide an additional layer of wildfire risk reduction by distributing water over your property. It does not guarantee protection of any structure or property in the event of wildfire or ember exposure.

EmberGuard must be used only in combination with other wildfire safety practices, including defensible-space maintenance, home-hardening strategies, and a well-planned evacuation protocol.

1. Evacuation and Fire Safety Responsibility

In the event of a wildfire, immediate evacuation is strongly recommended. This Product should never be relied upon as a primary means of protection, nor should it be used as a reason to remain in a building during a fire. Always follow emergency orders and evacuation guidance from local authorities.

2. System Operation and Water Supply Requirements

The Product will function only if properly installed, manually activated in advance, and supplied with a continuous flow of water at sufficient pressure. If the water supply is shut off, interrupted, or experiences inadequate pressure, the system will be ineffective.

EmberGuard should be deployed before wildfire conditions become hazardous.

3. Limited Warranty

The EmberGuard system includes a one-year limited warranty covering manufacturing defects in welding and paintunder normal use from the original date of purchase.

This warranty covers only the replacement of the original EmberGuard unit and does not cover:

All other components are sourced from third-party manufacturers and are not covered under this warranty. Warranty claims for third-party components must be directed to their respective manufacturers.

Liability under this warranty is strictly limited to replacement of the original product. By using EmberGuard, you agree to the terms of this limited warranty and accept all exclusions and limitations.

4. Risk Acknowledgment and Indemnification

By purchasing, installing, or using this Product, you assume all risks associated with its use. The manufacturer, seller, and affiliates make no guarantees regarding its effectiveness in any particular wildfire event.

To the fullest extent permitted by law, you agree to release, indemnify, and hold harmless the manufacturer, seller, and their officers, employees, and agents from any claims, damages, losses, liabilities, or legal actions arising from the use, installation, or performance of the Product. This includes, but is not limited to, claims related to personal injury, death, or property damage.

5. Not a Substitute for Fire Safety Measures

The EmberGuard system is not a standalone fire protection solution. It is designed to reduce risks associated with ember attacks but does not protect against direct flames, radiant heat, or high-intensity wildfire conditions.

You must use this Product only as part of a broader wildfire mitigation strategy, including but not limited to:

Failure to take these additional precautions significantly reduces the effectiveness of any wildfire defense system, including EmberGuard.

6. Compliance with Local Laws and Regulations

Users are responsible for ensuring that the installation and use of the Product comply with all applicable local, state, and federal regulations, including water use restrictions and fire safety codes.

7. Severability

If any provision of this disclaimer is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.

9. Installation Safety and Assumption of Risk

Installing EmberGuard involves working at height and on rooftops, which can be dangerous. By installing or arranging for the installation of this Product, you acknowledge and agree that:

Leg-Lock Warning: Ensure all four EmberGuard legs are fully extended and all knobs are securely tightened before operation. Partial deployment or loose hardware can lead to instability, tip-over, or damage when the unit is under water pressure.

10. Performance Disclaimer and Wind Advisory

The performance of the EmberGuard system is influenced by multiple environmental and installation-related variables. These factors may affect spray pattern, coverage area, and overall effectiveness:

Due to the variability of these external conditions, no specific performance or outcome is guaranteed during a wildfire event.

Wind Advisory: The EmberGuard unit is not intended to remain installed on rooftops during high wind events.

11. Water Supply and Compatibility Requirements

By purchasing, installing, or using this Product, you acknowledge that you have read, understood, and agreed to the terms of this disclaimer and limited warranty.
